    SC to hear plea against Section 6A of the Citizenship Act on Assam Accord: January 10,2023

    The AASU, the Government of India, and the Government of Assam came to a tripartite agreement on regards to immigrants validation to the country, and on August 15, 1985, the Assam Accord was signed. The deadline for foreigners verification was set at January 1, 1996.

    In order to give the Assam Accord effect, Section 6 A has been introduced. It provides the framework for either recognizing migrants in Assam as Indian citizens or for expelling them based on the date of their arrival.

    Assam Sanmilita Mahasangha, a civil society organisation based in Guwahati, and others challenged Section-A back in 2012, claiming that it is unfair, arbitrary, and unconstitutional in that it sets various cut-off dates for legalizing illegal immigrants who entered Assam and the rest of India.

    Tushar Mehta, the Solicitor General of India, asked the court to order the registry to send a soft copy of each plea to each counsel. The register was instructed to provide a full set to each counsel after the registry was granted the request.

    Senior attorney Ajay Tewari requested inclusion in the case on behalf of the State of Arunachal Pradesh to present arguments on the citizenship of Chakma refugees.

    CJI Chandrachud, however, said that after the current issues under consideration were heard, the same might be brought up.”Let us hear the main matter first. When matter opens, you can submit and we will hear you.”,he added.

    A decision on the matter is now scheduled for January 10, 2023.
